Abstract

The relevance of studying the means of territorial planning of defense and security facilities in the Soviet period is due to the need for their research in order to apply the experience gained in the conditions of the modern military-political situation, including in the territories newly incorporated into the Russian Federation. The subject of the study is the administrative acts of the authorities that determined the order of placement of defense and security facilities on the territory of the USSR. The purpose of the article is to determine the means of legal regulation of territorial planning in the area under consideration. The study was conducted using comparative legal and historical-legal methodology based on the legislation of the Soviet and modern period. As a result, the procedure for selecting land plots for the placement of military facilities, which has been in force since 1948, was considered. The significance of the legal acts of 1937, 1988 regulating the establishment of forbidden zones and forbidden areas in relation to objects of the Ministry of Defense, the State Security Committee, the Ministry of Internal Affairs of the USSR and their improvement in the historical process in the territorial planning of military facilities is shown. The article draws conclusions regarding the definition of certain means of legal regulation of territorial planning of military facilities and the need to improve the current legislation in this area. The historical and legal results and conclusions of the article can be used to improve the methodological support of the territorial planning process, as well as to improve the current legislation regulating the safe deployment of military facilities.
