Abstract

The commission of illegal drug sales using information and telecommunication technologies is currently the most commonly used method of their distribution by organized criminal groups. This form of criminal activity allows criminals to avoid the most vulnerable situations, significantly increase its secrecy. Due to its complexity and scale, this criminal activity requires special organization. The article shows the mechanism of functioning of criminal formations in the field of illicit drug trafficking using information and telecommunication networks, analyzes the modern organization of their criminal activities based on the fundamental provisions of the system-activity approach in criminalistics. The relevance of the study is dictated by a number of circumstances. Firstly, the fact that the organization of this type of criminal activity has not been adequately investigated by forensic science, and secondly, the current situation requires a significant modernization of the methods of investigation of this group of crimes, in which knowledge about the organization of the crime segment in question plays an important role. The article makes an attempt, based on the data obtained, to construct in the most general form a model of the functioning of this type of criminal activity, providing for the general management of the organizer of a criminal group, the actions of persons temporarily managing drug shipments, persons directly providing drugs to consumers, as well as persons performing auxiliary functions. This type of criminal activity is implemented by a system of complex actions undertaken by a collective subject, and their result is not the sum of these actions, but their new quality. Carrying out such actions requires the formation of a special management system and the training of special “managerial personnel”. The results of the study will make it possible to more effectively display and take into account all aspects of this negative phenomenon in practical activities.
