PECULIARITIES OF LEGAL CONSOLIDATION OF INFORMATION ON SANITARY PROTECTION ZONES IN THE RUSSIAN FEDERATION: ISSUES OF LAW ENFORCEMENT

Abstract

This article examines the social relations arising in connection with the legal consolidation of information on sanitary protection zones in the documents of town-planning legislation and the system of state registration of real estate. The authors analyze the complex of legal problems associated with the use of information on sanitary protection zones from the documents of town planning legislation and the system of state registration of real estate, and provide suggestions for their solution. The conclusions of the resolution of issues related to the establishment of the possibility or necessity of displaying information on various types of sanitary protection zones in the documents of territorial planning, urban zoning, urban plot plan, information system for urban planning, the Unified State Register of Real Estate and the public cadastral map are justified. In the course of the study, the principle of the responsibility of the authorities for ensuring favorable living conditions for a person is worked out, and the limitations of the powers of the right holders of land plots are established by displaying the sanitary protection zones in the documents of town planning legislation and the system of state registration of real estate.
