FEATURES OF THE LEGAL REGIME OF INSIDER INFORMATION

Abstract

In life of modern society different existence of information and sometimes such information is possible demands that it has been settled by means of the right. In case there is a settlement of information by means of precepts of law, then it is possible to speak about establishment of a legal regime of a concrete type of information. The author by means of the general model of a legal regime of information has in detail revealed structure of a legal regime of insider information. As methods of scientific research the system method, a structural method, and also a method of analogy and a comparative and legal method have been used. In view of the made analysis the author has come to valid conclusions that the direct purpose of establishment concerning insider information of a separate legal regime consists in providing the corresponding equality of participants of the exchange auction, and also that in view of inclusion in concept of "insider information" of other types of secrets there is a certain inconsistency between various legal regimes of information which will form the corresponding problems, both at the level of application of the right, and at the level of realization of the right. Besides at prevalence of a set of bans and holdings liable, the legal regime of insider information has rather expressed allowing focus.
