MEDIATION IN THE RUSSIAN CONDITIONS

Abstract

The article provides the analysis of a new procedure in the legislation of the Russian Federation - mediation as a way to resolve the conflict using third party not interested in the outcome of a case. The comparison of mediation with traditional judicial ways of dispute resolution is carried out. The author lists the advantages of mediation, discusses some problematic aspects, and proposes changes to the law in order to improve the procedure. The author offers to introduce mandatory mediation for certain categories of cases and to introduce mediation procedures into executive proceedings.
