TOPICAL ISSUES OF DETENTION AND PREVENTIVE MEASURES WHEN APPLIED TO FEMALE SUSPECTS AND ACCUSED

Abstract

The paper deals with the problems of applying a detention - one of the most common procedural enforcement measures in the Russian Federation. This procedural measure can be applied to women with young children or pregnant women only in cases of very serious crimes. The application of such a measure in relation to women is possible in exceptional cases, when these women committed serious crimes, and only with due account for their personality. The author analyzes different opinions concerning the interpretation and application of defined criteria, and proposes to amend Art. 91 of the Code of Criminal Procedure with regard to the legislative approach and the judicial practice.
