PROBLEMS OF IDENTIFICATION AND PECULIARITIES OF INSTITUTION OF CRIMINAL CASES ON WATER AND MARINE POLLUTION

Abstract

A stage of identification and institution of criminal cases on water and marine pollution has a number of features, in connection with which an investigator, the professionalism and proficiency of whom determine the further course of the investigation, needs to know the specifics of the preliminary verification of primary information about these crimes received from various sources, peculiarities of the interaction with environmental authorities, including the environmental Prosecutor's office. Typical reasons for the initiation of criminal cases of this category are systematized in the article; a list of state environmental control authorities is given; problems are identified and recommendations are formulated for the production of preliminary verification, the specific content of which is determined by the method of committing a crime, taking into account the situational approach. The research made it possible to draw a reasonable conclusion about the need for timely response of the investigation authorities to reports of criminal pollution of water and marine environment, the implementation of tactically competent interaction with environmental control authorities, specialists, the population and the mass media. The author proposes to adopt a single legal act regulating the activities of employees of regulatory authorities in the field of ecology at the detection of signs of crime.
